Louisiana’s Controlled Substance Schedules & Possession Penalties
Louisiana classifies controlled substances under five schedules. Schedule I substances are considered the most dangerous, with no accepted medical use. Schedule V substances carry the lowest abuse potential. The schedule a drug falls under directly determines the penalties you face.
Marijuana possession thresholds carry their own rules:
- 14 grams or less: Fine only, generally up to $100
- More than 14 grams: Penalties escalate by prior conviction, from around six months in parish jail and a $500 fine up to eight years in prison and a $5,000 fine
- 28 grams or more of a Schedule I or II substance: Generally one to twenty years, plus a fine up to $50,000
For other controlled substances, the ranges by schedule are generally:
- Schedule I (under 2 grams): Up to two years and a $5,000 fine
- Schedule II (under 2 grams): Up to two years and a $5,000 fine; two to twenty-eight grams typically raises that to one to five years
- Schedule III: One to five years and a $5,000 fine
- Schedule IV: One to five years and a $5,000 fine, with convictions involving flunitrazepam potentially carrying up to 10 years
- Schedule V: One to five years and a $5,000 fine
A second or subsequent offense generally doubles the applicable fine, prison term, or both. Possession within 2,000 feet of a drug-free zone, which can include schools, public parks, playgrounds, daycares, colleges, and drug treatment facilities, may increase maximum penalties.

How Drug Possession Charges Move Through Lafayette Parish Courts
The 15th Judicial District Court holds original jurisdiction over criminal matters in Lafayette, Acadia, and Vermilion Parishes. Where your case is heard depends on the nature of the charge. Misdemeanor drug offenses, including small-quantity marijuana possession and paraphernalia charges, are generally handled through the misdemeanor section of the district attorney’s office. If the offense occurred within city limits, it may go through Lafayette City Court. Felony drug charges carrying a hard-labor sentence move through a designated felony court section.
Depending on your history and the charge, you may qualify for alternatives to a traditional prosecution. The District Attorney’s Pre-Trial Intervention Program is available to certain eligible offenders and, if successfully completed, may support a motion to expunge the arrest record. The 15th Judicial District Court also operates an Adult Therapeutic Drug Court Program, a specialized form of probation targeting non-violent, probation-eligible defendants whose criminal activity stems from substance abuse. The program focuses on sobriety, employment, and reducing reoffending. Eligibility for either program is determined by the district attorney and the presiding judge.
