What Crimes Can Be Expunged in Louisiana?
Whether a conviction can be expunged depends on the offense type, how it was resolved, and whether certain waiting periods and conditions are met under Louisiana law. Arrests that didn’t result in conviction are usually eligible, as are qualifying misdemeanors when certain requirements are fulfilled.
There are two primary ways to qualify for expungement under Louisiana law:
- The conviction was set aside and prosecution was dismissed, or
- More than 10 years have passed since you completed any sentence, deferred adjudication, parole, or probation, and you haven’t been convicted of any other criminal offense during that time, and you have no criminal charge currently pending against you (CCRP 978).

What Happens After an Arrest in Louisiana?
Being arrested is stressful and disorienting, especially if it’s your first time navigating the criminal justice system. Knowing what to expect helps you protect your rights and make informed decisions at each stage. In Lafayette Parish, felony arraignments take place before a judge in the 15th Judicial District Court. Qualifying misdemeanors are handled in the City Court of Lafayette.
A criminal case in Louisiana generally moves through these stages:
- Booking. Law enforcement collects your photo and fingerprints. You may be held in a parish jail until your initial appearance or bond hearing.
- Arraignment. You appear before a judge, who informs you of the charges, your rights, and whether you’re eligible for bail or bond.
