What Crimes Can Be Expunged in Louisiana?

Whether a crime can be expunged depends on the type of offense, how it was resolved, and whether certain waiting periods and conditions are met under Louisiana law. Arrests that did not result in conviction are usually eligible for expungement, as well as qualifying misdemeanors when certain requirements are fulfilled.

There are typically two ways to qualify for expungement:

  1. The conviction was set aside and the prosecution was dismissed, or
  2. More than ten years have passed since you completed any sentence, deferred adjudication, parole, or probation, and you have not been convicted of any other criminal offense during that time (CCRP 978).

What Happens After an Arrest in Louisiana?

Being arrested can be stressful and confusing, especially if it’s your first time navigating the criminal justice system. Knowing what to expect can help you protect your rights, make informed decisions, and reduce uncertainty during this process.

After an arrest, the criminal case generally moves through the following stages:

  1. Booking. Law enforcement will collect your photo and fingerprints. You may be held in a parish jail until your initial appearance or bond hearing.
  2. Arraignment. You will appear before a judge, who will inform you of the charges, your rights, and whether you are eligible for bail or bond.
  3. Bail or bond hearing. The court determines whether you can be released while your case is pending and sets any bail amount, if applicable.
  4. Pre-trial proceedings. Your lawyer may file motions, review evidence, and negotiate with the district attorney to minimize charges or penalties if possible.
  5. Plea or trial. If a plea agreement isn’t reached, your case may proceed to trial, where it will be heard before a judge (bench trial) or jury (jury trial).
  6. Verdict. The judge or jury will issue a verdict of guilty or not guilty. If a guilty verdict is found, the judge will impose a sentence, which may include fines, probation, or jail time.
